Cincinnati, Ohio - In a stinging defeat for the Bush Environmental Protection Agency, the 6th Circuit Court of Appeals today issued a clear rebuke against the administration’s 2006 rule which exempted certain commercial pesticide applications from the oversight provided by Congress under the Clean Water Act. The Court held that pesticide residuals and biological pesticides constitute pollutants under federal law and therefore must be regulated under the Clean Water Act to minimize the impact to human health and the environment.

Washington, D.C. – The U.S. Environmental Protection Agency today signed off on a controversial 11th hour repeal of the stream buffer zone rule, an environmental law which since 1983 has prohibited surface coal mining activities within 100 feet of flowing streams.

Cherokee Mining, LLC, the federal Eleventh Circuit Court of Appeals ruled on November 13, 2008 that a Clean Water Act citizen suit is not barred by a state administrative action commenced after a citizen group gives notice of its intent to sue to abate water pollution.

On Friday, December 14th the Environmental Management Commission (EMC) will discuss whether to strengthen the standards governing cancer risk level allowed in our state’s waterways. The next step in this process, should the EMC decide to move forward, will be to initiate rule-making to begin the process of making this important change.
